Leighton for preliminary approval in the proposed class action litigation involving claims that the popular “take-and-bake” pizza chain Papa Murphy’s violated the federal Telephone Consumer Protection Act (“TCPA”). Named plaintiffs John Lennartson, Rita Andrews, Cassie Asleson and Susan Shay Nohr alleged in the complaint, filed in 2015, that Papa Murphy’s consistently sent unsolicited promotional text messages. The $22.6 million settlement is comprised of $11.3 million in Papa Murphy’s merchandise vouchers and $11.3 million in a cash settlement fund. The class is made up of all people nationwide who received one or more unsolicited promotional text messages from the defendant from October 16, 2013 to June 15, 2015. Class members will be sent two $5 Papa Murphy’s vouchers regardless if they submit class forms. However, if a class member does fill out the appropriate class forms, they will be sent $10 in cash from the settlement fund. The case is: *Lennartson v.
